TITLE INSURANCE FAQ
WHAT IS TITLE INSURANCE?
Title insurance protects property owners and lenders* against financial loss from defects or issues that existed prior to the time the insurance policy was purchased; this can include but is not limited to undisclosed liens, fraud, or errors in public records. Title Insurance does not cover issues created after the purchase of the property.
WHO NEEDS TITLE INSURANCE?
Most real estate attorneys strongly recommend that purchasers of Real Property (condos, townhouses, single family homes, commercial properties) obtain Title Insurance.
WHY IS TITLE INSURANCE NEEDED?
Although part of a buyer’s attorney’s due diligence is obtaining and reviewing a thorough title search, which is ordered and reviewed once a contract of sale is fully executed, there is always the possibility of unknown issues surfacing postpurchase. Title Insurance covers legal defense costs and financial losses tied to resolving those issues.
HOW IS A PROPERTY DEEMED INSURABLE?
Once a Contract of Sale is fully executed, the buyer’s attorney will order a Title Report which outlines the property’s history to be sure there are no outstanding issues (liens, unpaid taxes, judgments etc.) to be resolved prior to closing. Once the Title is “free and clear” of any issues, the property is then deemed insurable and the policy is issued.
WHEN DOES COVERAGE START AND HOW LONG DOES IT LAST?
Coverage starts at closing and the policy lasts as long as the purchaser, or their heirs, own the property.
WHO PAYS FOR TITLE INSURANCE?
Typically, the buyer is responsible for paying the cost of Title Insurance at closing.
HOW MUCH DOES TITLE INSURANCE COST?
Title premiums are regulated by the state and based on the purchase price and/or loan amount. Premiums are a onetime fee, paid at closing.
WHAT HAPPENS IF THERE IS A CLAIM AGAINST A PROPERTY?
If there is a claim against a property, the current owner of the property should contact their Title Insurance company immediately. They will provide a legal defense and cover financial losses, up to your policy limit, if the claim is valid.
*WHAT IS THE DIFFERENCE BETWEEN AND OWNER’S POLICY AND A LENDER’S POLICY?
If mortgaging a property, the Lender will also need their own Title Insurance policy. These rates are also set by the state and paid for by the purchaser at closing. The Lender’s Policy protects the mortgage lender’s interest until the loan is paid off whereas an Owner’s Policy protects the purchaser’s interest for as long as they own the property.
